Philippines Travel Insurance News

The Court of Queen’s Branch of Alberta ruled on Monday, April 30, 2018, that the SEF 44 Family Protection Endorsement in the standard auto policy of Alberta would provide accident benefits coverage for accidents that took place outside Canada.

Leizle Wage was struck and killed by a motorcycle while on vacation in the Philippines. Wage and her husband had a standard auto policy with Canadian Direct Insurance in Alberta. The policy includes the SEF 44 Family Protection Endorsement.

Leizle’s estate argued in the court that coverage under the SEF 44 endorsement is not excluded in Alberta’s standard auto policy’s territorial limit. However, Canadian Direct Insurance denied the claim in the court, stating that accidents that took place in the Philippines are not included in the endorsement coverage.

Although SEF 44 endorsement talks about places or jurisdiction where the accident occurred, it does not point out any express limitation except for the province of Quebec.
