After his Doberman Pinscher bit four people, Rob Szalas was ordered to turn over the dog to be euthanized but when Szalas refused, he was found in contempt by the court.

The Ontario’s Court of Appeal said that Mr. Szalas showed blatant contempt for the administration of justice by ignoring the demands and orders of the court and sending his animal to the United States.

Szalas initially turned over his Doberman when ordered by Dr. Jim Chirico, the medical officer of health for the North Bay Parry Sound District Health Unit, to do so but later appealed the euthanasia order. He was allowed to keep the dog pending the outcome of the process. Court records show that Szalas breached a number of conditions which include that the dog be muzzled and leashed.

Szalas’ appeal was rejected ultimately and a representative of the Society for the Prevention of Cruelty to Animals went to his home to retrieve the dog; Szalas refused to release his dog but rather sent it to the United States.

The Appeal Court ruled that the days are long gone when someone subject to a court order can get away by circumventing it. In order to allow Szalas the chance to purge his contempt, the Appeal Court referred the matter back to a lower court. The lower court will determine the appropriate sanction. However, the court also ordered Szalas to pay Chirico $1,500 in costs for the appeal.
